An incarcerated man was denied transportation in order to appear for his small claims hearing to present written evidence. Instead, he conducted his hearing over telephone without any way to submit the written evidence. A trial court ruled against him and he appealed to the NH Supreme Court.
A single mother of two was ordered to jail if she did not pay a fine she didn't have the means to pay. After spending a night in jail, the ACLU-NH filed an emergency petition for writ of habeas corpus seeking her release; she was granted release immediately.
On Thursday, February 20, 2014, after the NHCLU filed an emergency petition, the New Hampshire Supreme Court took swift action delaying enforcement of an order issued by a lower Circuit Court that would have jailed a defendant simply for being poor.
After receiving a demand letter from the NHCLU, on February 18, 2014, the Rochester City Council, by a vote of 9 to 0, repealed in its entirety an anti-panhandling ordinance it passed in July 2013 that violated the free speech rights of the poor and homeless. This ordinance was intended to prevent so-called “aggressive” begging, but in fact it prohibited a large amount of peaceful speech.
